من المبادئ الأساسية أن الشخص يتمتع بحرّيّة الانفكاك من محاميه أو مستشاره لأجل أن يأخذ استشارة أخرى. إذا كنت مرتبطاً بإجراء قضائي معين كإجراء تقديم الدعوى أو تحريرها أو المرافعة وطلبتَ الإستشارة من أحد المحامين ولِسبب أو لآخر تريد استبدال هذا المستشار بآخر فَلَكَ كامل الحق. إلا أنّه عليك أن تتخذ الاحتياطات العمليّة اللازمة. فمن ناحية فهذا التغيير يجب أن لا يضُر مصالحك القانونية ولا يلحق في ذلت الوقت ضررا بمستشارك من ناحية أُخرى . فيجب أن تكون قد دفعت كامل قيمة فاتورة الاستشارة بصرف النظر عن كونها مُكتملة العناصر أو أنك قطعتها قبل أن تكتمل.
ومن جانب آخر وحتى تكون في مأمن عند تغيير مستشارك أو محاميك فيجب أن تتخذ الخطوات الآتي:
١– أبلغ مستشارك الجديد عن إسم مستشارك السابق وعنوان مقره وذلك ليقوم بالخطوات الأخلاقية اللازمة.
٢– من الضروري إعلام مستشارك السابق كتابة سواء عبر الإيميل أو عبر البريد وذلك بحسب الطريقة المتفق عليها عند تعاقدك معه.
٣–وتذكر له الرسوم المستحقة واستعدادك للوفاء بها
٤–ختاماً تطلب منه نقل ملف الاستشارة أو القضية الى مستشارك الجديد.
في حال الخلاف على عدد ساعات العمل المنجزة من قبل “مستشارك السابق” عادة يتم الاستفادة من رأي أهل الخبرة.
يغيب عن الأذهان أن المحامي الجديد لا يستطيع اتخاذ أي إجراء في مواجهة المحامي السابق، وإنما على العميل أن يستعين بمحام آخر أو لوحده إذا أراد حل النزاع عن طريق القضاء. وفي جميع الأحوال يجب أن يتمتع العميل بالشفافية الكافية أمام القضاء
